Rules & Procedures for Participation

*Pecan Street Collective (PSC) rules are subject to change by PSC leadership at any point.

Introduction

The Pecan Street Collective (referred to henceforth as the “PSC”) is a once a month pop-up market with local makers, vendors, artists, and businesses. The mission of the PSC is to unite local businesses with the community, foster a #buylocal mentality and create an event that’s welcoming for all ages. 

The PSC is typically on the first Saturday from 10am-3pm Downtown Pflugerville, TX. Booth spaces are located at the following businesses: West Pecan Coffee + Beer, Stylin’ Salon, Ruffles and Rust, Ceramics N More, and Hassell Dental. The PSC operates in accordance with all city, county, state and federal laws pertaining to its operation. The PSC is a project sponsored by Two Brews, LLC dba West Pecan Coffee + Beer, Two Brews Holdings, LLC, Stylin’ Salon, Ruffles and Rust, Ceramics N More, and Hassell Dental.

Vendor Categories:

Cottage Food Business

-Any business that falls within the parameters of a cottage business per the requirements here: https://texascottagefoodlaw.com

-Examples: Baked Goods, Jams/Jellies, Salsa, etc.

Prepared Food:

-Vendors offer freshly made food and drinks available for sale and immediate consumption on-site at PSC. These products may be hot or cold ready-to-eat foods or drinks. Commercial kitchens must be located within 150 miles of the market.

-Examples: Waffles, Brisket, Iced Beverages, etc.

Food Trucks:

-Vendors who have a food truck with an active Travis County and Pflugerville permit.


Artisan:

Products created by a local artisan located within 150 miles of the market attended.

-Examples: Beauty and skincare products, jewelry, art, ceramics


Vendor Fees:

Booth Fee: Booths at West Pecan Coffee + Beer are $40 for a 10×10 booth space. Booths at Stylin Salon and Hassell Dental are $25 for a 10×10 booth space. Booths at Ruffles and Rust and Ceramics N More are $10 for a 6×6 booth space. Payments must be made in order to secure the booth space. Booth assignments at all locations are subject to relocation at the discretion of the Market Coordinators.

Market Rules:

All invitations to sell at the PSC are at the discretion of the Market Coordinators.

  1. Market rules must be read and acknowledged via the Liability and Hold Harmless Agreement for each person working in the booth before vendors attend any market.
  2. All vendors must fill out and sign the vendor application.
  3. Copies of all proper permits, certifications, licenses, etc. must be received by PSC before a vendor can attend any market.
  4. Any agent working at a PSC vendor booth is held to the Liability and Hold Harmless Agreement which the business owner/manager/agent signed.
  5. Booth fees will only be refunded on a case by case basis and are subject to the approval of the Market Coordinators.
  6. This Agreement is non-exclusive and the PSC reserves the right to contract with other vendors for the Event and there is no guarantee of exclusive category for any vendor.
  7. New items (not included in the most recent application) must be submitted in writing via email and approved by the Market Coordinators before being sold at market.
  8. All items sold at the market must be prepared by the vendor within 150 miles of the market unless a different arrangement is agreed upon by the Market Coordinators.
  9. Laws, Procedures, and rules put forth by the federal, state, city, or county government must be followed by all vendors.
  10. Re-selling of any products or goods is prohibited (food vendors may blend or infuse products to make a final product of their own).
  11. Markets operate year-round, rain or shine. No refunds or discounts in fees will be given in the event of inclement weather or lack of business due to the weather. If the weather becomes too intense we will cancel the market.
  12. Vendors must be set up & ready to sell no later than 15 minutes before the market opens.
  13. Vendors must park in outlying areas. Vendors may not park in customer parking for any reason.
  14. Vendors may not break down their booth space before the end of the market even in the event the vendor has sold out. Tables, signage, tablecloth etc. must remain set up in booth space until the end of the market. Vendors must break down promptly at market close. No driving within market boundaries is permitted until 15 minutes after the close of any market. Vendor shall leave the location free from trash and in similar condition that it was in before the Vendor set up. 
  15. Smoking and vaping is not permitted in market territory. Vendors must leave market boundaries so that smoke or vape does not reach shoppers or other vendors. Cigarette butts must be properly disposed of in safe containers and removed by the vendor.
  16. Only generators at or below a decibel level of 60 are permitted at the market to minimize noise pollution.
  17. Assignment of Space: Vendors’ booth locations may change market-to-market and vendors are expected to exercise flexibility in the event of relocation. Vendor acknowledges that the size, location and configuration of the vendor Spaces may vary and are subject to change. PSC shall be entitled, in its sole discretion, to market, position and determine assignment of Spaces to all vendors, including the Vendor, within the Market; and provided further that Vendor hereby accepts all such determinations as final. There is no transfer, assignment, sublicensing, or subletting of the Space to any third party without permission from the Market Coordinator. In addition, Vendor shall not market, display or sell merchandise of any third party without prior written approval from PSC Market Coordinator.
  18. Vendors may not bring pets to the market unless they sell pet products, use a service animal, or it is previously agreed upon by the Market Coordinators.
  19. Intoxication from alcohol or illegal drugs will result in vendor expulsion from the Market.
  20. Discrimination in any form is prohibited. Discrimination is the treatment or consideration of, or making a distinction in favor or against, a person based on the group, class, or category to which that person belongs, including but not limited to race, color, national origin, age, disability, economic class, sex, gender expression or sexual orientation.
  21. All food vendors must comply with Federal, State, Pflugerville and Travis County Health Department rules.
  22. Follow labeling requirements from the State of Texas, which state all food items must be clearly labeled and include: 1. Contact information: address, phone # and/or email address 2. Contents: Name of item should include common and usual name 3. List of ingredients according to weight. 4. Eight common allergens. Cottage law vendors must indicate on product labels this statement: This product is not inspected by any state of Texas or local health department.   23. Health Department violations must be corrected before a vendor is allowed to set up on the next market date.
  24. Vendors are required to comply with state and federal laws concerning firearms and may not openly display firearms while selling at the market.
  25. Vendors must contribute to accessibility at the market by clearing a fire lane and maintain an ADA pathway.
  26. No disruptive or aggressive marketing is permitted at the market.
  27. Any vendor selling CBD products must provide detailed sourcing and extraction information and provide proof of purchase from the source company. Additional information may be requested by the Market Coordinators. Products may not be sold or sampled to minors (under the age of 18) without a parent/guardian’s presence and permission.
  28. Artisans will be subject to a jury of their product by the Market Coordinators and/or the appointed PSC team member before being allowed to sell at any market. This review takes place in the application process. The Market Coordinators or the PSC team members have the right to review any merchandise for sale at any market at any time. Photos of the work or links to photos of the work must be submitted with the application.
  29. Insurance: Vendor is solely responsible to obtain insurance coverage on property brought into any buildings or spaces designated for the PSC. Vendor assumes full responsibility for items left in the facility or premises. PSC accepts no liability for lost, stolen or damages property and is not required to carry additional insurance to cover Vendor’s property. The PSC is not liable for any injuries caused by vendors to vendors, customers, or anyone else on the property.
  30. The Market Coordinators maintains current and accurate records of each Vendor.
  31. The Market Coordinators promotes and advertises the market through paid and free media,
    including public service announcements, local businesses, civic groups, neighborhood
    associations, and the public, using all venues available to the City’s Public Information Officer
  32. Vendors are responsible for bringing their own tables, chairs, tents, signs, and/or other
    equipment.
  33. Vendors are responsible for their own booths set-up and tear-down.
  34. All signs must be kept within the boundaries of their assigned booth space.
  35. The Market Coordinators has the authority to issue warnings and take appropriate action against
    participating sellers/vendors who violate the By-Laws contained in this document. The Market Coordinators have the power to immediately suspend or remove any vendor for any health, safety, and liability risks by any violation.
  36. The Market Coordinators may expel any vendor from the Market if it is determined that this would be in the best interest of the PSC.
  37. No Multi Level Marketing vendors will be allowed.
  38. Situations not covered in this document will be handled at the discretion of the Market Coordinators or a West Pecan Coffee + Beer employee accordingly.

Two Brews, LLC, Two Brews Holdings, LLC  and/or any Pecan Street Collective staff member is not responsible forproduct liability, fines, penalties or the paying of sales taxes for individual vendors. All vendors are responsible for collecting and paying Texas State Sales Tax as applicable for their product. Harassment:

Harassment based upon an individual’s sex, race, ethnicity, national origin, age, religion or any other legally protected characteristics will not be tolerated. All employees, including supervisors and other management personnel, are expected and required to abide by this policy. No person will be adversely affected in employment with the employer as a result of bringing complaints of unlawful harassment.

Other standards and conduct:

Vendors should be knowledgeable about products, how they are used, grown or produced and be able to communicate these things clearly to the customers. Products should be displayed in a sanitary, presentable and attractive manner. Vendors are expected to be courteous, professional and presentable at all times. All vendors must honestly represent their products. Inappropriate language or behavior, clothing, harassment or abuse toward anyone at any market will not be tolerated and may be reason for expulsion.

Onsite Resolution:

PSC will make every effort to reach a resolution in the event an issue arises. At the market, Market Coordinators are the first step in resolving issues. Please locate a Market Coordinator and discreetly inform them of the issue at hand. Market Coordinators may be able to resolve the issue immediately, or they may choose to gather information to deliver in writing to the Market Coordinators for further consideration. Vendors must abide by the final decision of the Market Coordinator or PSC Leadership.

Pecan Street Collective Rules and Procedures must be acknowledged by all vendors and agents who will be representing any vendor by signing the Liability Waiver and Hold Harmless Agreement.
